Upon
the
motion

applicant,
Alfred

Carew,

set
aside,
or
suspend
the
operation
of
the
judgment
pronounced
on
March
25,
1994
by
the
Honourable
Judge
A.A.
Sarchuk
in
this
matter;
And
upon
reviewing
the
material
submitted
in
support
of
this
motion
and
the
representations
of
the
respondent
in
reply;
The
Court
notes
that
in
essence,
the
motion
is,
as
represented
by
the
respondent,
that
this
judge
set
aside
or
suspend
the
operation
of
the
judgment
of
the
learned
trial
judge
on
the
basis
of
errors
committed
by
the
learned
trial
judge
in
permitting
certain
evidence
to
be
adduced
and
errors
in
the
learned
trial
judge’s
assessment
of
the
evidence.
And
the
Court
noting
that
this
matter
has
been
appealed
to
the
Federal
Court
of
Appeal;
It
is
this
Court’s
view
that
these
matters
are
matters
for
the
Federal
Court
of
Appeal
to
determine,
and
are
not
matters
for
further
review
by
a
judge
of
this
Court.
In
these
circumstances
the
motion
is
dismissed
and
the
respondent
is
awarded
costs
which
are
fixed
at
$400.00
which
are
to
be
paid
forthwith.
Motion
dismissed.
