1 La Forest J. ‑‑ The application for leave to appeal is granted.
2 We are all of the view that the appeal should be allowed essentially for the reasons given by Bisson J.A., dissenting in the Court of Appeal. Accordingly, the appeal is allowed, the judgment of the Court of Appeal is set aside and an order is made in accordance with the conclusions of Bisson J.A.’s opinion.
