[1] I am satisfied that, in view of my reasons and order in T-1411-98, special circumstances exist to hear the present judicial review applications which are with respect to interlocutory evidentiary decisions.
[2] Since Ms. Devins participated in the two decisions under review, and since these decisions were rendered in a condition of apprehension of bias, although specifically relating to her only, they cannot stand.
[3] Accordingly, each decision is quashed.
[4] As he is successful in these applications, on each application I award costs to the applicant to be paid by the respondents jointly, excluding the Canadian Association for Free Expression.
