Principales Questions: Dans divers scénarios, est-ce qu’un copropriétaire peut demander l’exemption pour résidence principale à l’égard d’un espace de stationnement détenu avec une unité dans un immeuble en copropriété divise? / In various scenarios, whether or not the principal residence exemption may be claimed by a co-owner in respect of a parking space held with a unit of an immovable in a divided co-ownership.

Position Adoptée: Nous sommes prêts à accepter qu’un Stationnement qui facilite l’usage de l’Unité pourrait être une composante du logement et à ce titre se qualifier comme «résidence principale» telle que définie à l’article 54 dans la mesure où toutes les autres conditions prévues à cette définition sont respectées. Toutefois, dans le cas d’un Condominium, en plus de la présence de faits pertinents nous permettant de conclure que le Stationnement pourrait être considéré comme faciliter l’usage de l’Unité, nous exigerons que le lot du Stationnement fasse partie des parties privatives ou des parties communes de l’immeuble qui comprend l’Unité, le tout selon la déclaration de copropriété de cet immeuble. L’Unité et le Stationnement devront être la propriété de la même personne. / We can accept that a parking space that is regarded as contributing to the use and enjoyment of the Unit could be a part of a housing unit and as such could qualify as a "principal residence" as defined in section 54 to the extent that all the other requirements of this definition are met. However, in the case of a Condominium, in addition to the presence of relevant facts which allow us to conclude that the parking space could be considered to contribute to the use and enjoyment of the Unit, we will require that the parking space lot is part of the private portions or common portions of the immovable that includes the Unit, all according to the declaration of the divided co-ownership of this immovable. The Unit and the parking space have to be owned by the same person.

Raisons: Les questions à savoir si le remboursement des frais de repas est principalement pour le bénéfice de l'employeur et si les frais de repas ont été engagés dans l’accomplissement des fonctions de son emploi sont des questions de fait qui ne peuvent être résolues qu'après un examen de tous les faits reliés à cette situation particulière. / Whether the reimbursement of meals expenses is primarily for the benefit of the employer and if the meal expenses were incurred in the performance of the employee's duties of employment are questions of facts that cannot be resolved without examining all relevants facts of this particular situation.
