Dear Madam,

This is in response to your document faxed on September 14, 2005 to Revenu Québec, Tax Legislation Branch. Since this request was regarding federal taxation of these premiums, they advised the officer in charge of the file that the request had been transferred to us on September 28, 2005.

Unless otherwise indicated, all statutory references herein are to provisions of the Income Tax Act (the "Act").

Your analysis:

You stated that representatives of certain regions are of the opinion that the location incentive program for medical practitioners setting up in designated territories is not taxable.

Our Comments:

As stated in paragraph 22 of Information Circular 70-6R5 dated May 17, 2002, it is the practice of the Canada Revenue Agency (the "CRA") not to issue written opinions on proposed transactions other than by way of advance rulings. Furthermore, when it comes to determining whether a completed transaction has received appropriate tax treatment, that determination is made first by our Tax Services Offices as a result of their review of all facts and documents, which is usually performed as part of an audit engagement. However, we can offer the following general comments that we hope may be helpful to you. These comments may, however, under certain circumstances, not apply to your particular situation.

Non-salaried medical practitioners

With respect to self-employed medical practitioners, the Act provides general statutory provisions indicating certain items that must be included in computing the income from a business. Subsection 12(1) sets out most of the items to be included in computing the income from a business. Paragraph 12(1)(x) specifically addresses inducement and other payments. The CRA also issues Interpretation Bulletins to provide technical interpretations and positions on certain provisions of the Income Tax Act.

Interpretation Bulletin IT-273R2 discusses the tax treatment of forms of government assistance received by a taxpayer in a year in which the taxpayer earns income from a business or property. That financial assistance may be provided as an incentive payment (e.g., to encourage employment, to reduce the production of certain inventories, such as fish or commodities) or as a result of government action other than expropriation (e.g., an order to destroy certain capital assets or inventories owned by the taxpayer, such as diseased animals) or in respect of the loss of income or property as a result of a disaster (e.g., flood, frost or explosion).

Issue 23 of the Bulletin deals specifically with "Inducements to Medical Practitioners" and reads as follows:

“Government organizations may provide financial incentives to recruit health care professionals to practice in designated underserviced areas. Such grants are included in income under paragraph 12(1)(x) when none of the exceptions described in ¶ 8 applies.”

In view of the foregoing, it is our opinion that signing bonuses paid to physicians under programs established by the Government of Quebec to encourage physicians to establish in remote areas are taxable to physicians who carry on a medical practice in a designated area. Those amounts are not covered by the exceptions to the income inclusion requirement in paragraph 12(1)(x). Thus, those bonus amounts are taxable as business income.

Salaried medical practitioners

With respect to salaried medical practitioners, the location incentives paid to medical practitioners under the programs put in place by the Quebec government to encourage medical practitioners to establish in remote areas are also taxable to medical practitioners who practice their profession exclusively as employees. They will thus be taxable as income from office and employment pursuant to paragraph 6(1)(a) since the incentives come directly from the employer. For that reason, the incentives are considered to be received by virtue of the physician’s employment.

La présente est en réponse à votre document faxé le 14 septembre 2005 à Revenu Québec, Direction des lois sur les impôts. Puisque cette demande visait d'une part l'imposition de ces primes sur le plan fédéral, ces derniers ont avisé l'agente responsable au dossier que la demande nous avait été transférée le 28 septembre 2005.

À moins d'indication contraire, tous les renvois législatifs dans la présente sont des renvois aux dispositions de la Loi de l'impôt sur le revenu ("Loi").

Nos commentaires:

Tel qu'il est mentionné au paragraphe 22 de la Circulaire d'information 70-6R5 du 17 mai 2002, l'Agence du revenu du Canada (ci-après l'"ARC") a comme pratique de ne pas émettre d'opinion écrite concernant des transactions projetées autrement que par voie de décisions anticipées. Par ailleurs, lorsqu'il s'agit de déterminer si une transaction complétée a reçu le traitement fiscal adéquat, la décision en revient d'abord à nos bureaux des services fiscaux à la suite de l'examen de tous les faits et documents, ce qui est généralement effectué dans le cadre d'une mission de vérification. Nous pouvons toutefois vous offrir les commentaires généraux suivants qui, nous l'espérons, vous seront utiles. Ces commentaires pourraient cependant, dans certaines circonstances, ne pas s'appliquer à votre situation particulière.

Médecins non-salariés

En ce qui concerne les médecins non-salariés, la Loi prévoit des dispositions législatives générales indiquant certains éléments qui doivent être inclus dans le calcul du revenu provenant d'une entreprise. Le paragraphe 12(1) indique la plupart des éléments à inclure dans le calcul du revenu provenant d'une entreprise. L'alinéa 12(1)x) vise précisément les paiements incitatifs et autres. L'ARC publie également, des bulletins d'interprétation pour donner une interprétation technique et faire connaître sa position concernant certaines dispositions de la Loi de l'impôt sur le revenu.

Le bulletin d'interprétation IT-273R2 aborde le traitement fiscal réservé aux formes d'aides gouvernementales qu'un contribuable reçoit au cours d'une année pendant laquelle il tire un revenu d'une entreprise ou d'un bien. Cette aide financière peut être versée à titre de paiement incitatif (exemple: mesures visant à favoriser l'emploi, à réduire la production de certains stocks, comme du poisson ou des denrées) ou suite à une mesure gouvernementale autre que l'expropriation (exemple: une ordonnance visant la destruction de certaines immobilisations ou de stocks appartenant au contribuable, par exemple des animaux malades) ou relativement à la perte d'un revenu ou d'un bien survenue à la suite d'un désastre (comme une inondation, une gelée ou une explosion).

Le numéro 23 du Bulletin porte précisément sur les "Paiements incitatifs versés à des médecins" et se lit comme suit:

"Des organisations gouvernementales peuvent verser des paiements incitatifs afin d'amener des professionnels de la santé à exercer dans des régions désignées dépourvues de services médicaux. De telles subventions sont incluses, en vertu de l'alinéa 12(1)x), dans le calcul du revenu quand aucune des exceptions décrites au numéro 8 ne s'applique."

Compte tenu de ce qui précède, nous sommes d'avis que les primes d'installation versées aux médecins dans le cadre des programmes mises en place par le gouvernement du Québec afin de favoriser l'installation des médecins dans les régions éloignées sont imposables pour les médecins qui exercent une pratique médicale dans une région désignée. Ces montants ne sont pas visés par les exceptions à l'exigence d'inclure au revenu prévue à l'alinéa 12(1)x). Ainsi, ces montants versés sous forme de primes sont imposables à titres de revenu tiré d'une entreprise.

Médecins salariés

En ce qui concerne les médecins salariés, les primes d'installation versées aux médecins dans le cadre des programmes mises en place par le gouvernement du Québec afin de favoriser l'installation des médecins dans les régions éloignées sont également imposables pour les médecins qui exercent sa profession exclusivement à titre d'employé. Il sera ainsi imposable à titre de revenu de charge et d'emploi en vertu du paragraphe 6(1)a) étant donné que les primes lui proviennent directement de son employeur. Pour cette raison, les primes sont considérées être reçues en vertu de son emploi.
