Droit de bénéficiaire
Le sous-alinéa 55(5)e)(ii) L.I.R. énonce certaines règles pour déterminer si des personnes sont liées entre-elles aux fins de l'article 55 L.I.R.. Le sous-alinéa 55(5)e)(ii) L.I.R. stipule ce qui suit:
"(ii) dans le cas où une personne est liée, à un moment donné, à chaque bénéficiaire, autre qu'un organisme de bienfaisance enregistré, d'une fiducie qui a ou peut avoir droit, pour une raison autre que le décès d'un autre bénéficiaire de la fiducie, à une part du revenu ou du capital de la fiducie, la personne et la fiducie sont réputées être liées entre elles à ce moment; à cette fin, une personne est réputée être liée à elle-même, "

" (ii) where at any time a person is related to each beneficiary (other than a registered charity) under a trust who is or may (otherwise than by reason of the death of another beneficiary under the trust) be entitled to share in the income or capital of the trust, the person and the trust shall be deemed to be related at that time to each other and, for this purpose, a person shall be deemed to be related to himself, herself or itself, "

D'autre part, l'alinéa 248(25)a) L.I.R. stipule ce qui suit:
" a) comptent parmi les personnes ou sociétés de personnes ayant un droit de bénéficiaire dans une fiducie donnée celles qui ont le droit - immédiat ou futur, conditionnel ou non, ou soumis ou non à l'exercice d'un pouvoir discrétionnaire par une personne ou une société de personnes - à titre de bénéficiaire d'une fiducie de recevoir tout ou partie du revenu ou du capital de la fiducie donnée, soit directement de celle-ci, soit indirectement par l'entremise d'une ou plusieurs fiducies ou société de personnes; "

Est-ce que l'ARC peut préciser s'il existe une distinction entre l'interprétation devant être donnée aux deux textes ou si le sous-alinéa 55(5)e)(ii) L.I.R. doit être interprété à la lumière de l'alinéa 248(25)a) L.I.R.? Le cas échéant, pourquoi cette différence existe-t-elle et comment doit-on l'interpréter et pourquoi n'a-t-on pas simplement référé à l'alinéa 248(25)a) L.I.R. au sous-alinéa 55(5)e)(ii) L.I.R. tout en excluant le cas devant être exclu?
Réponse de l'ARC
Le sous-alinéa 55(5)e)(ii) L.I.R. énonce une règle pour déterminer si une personne et une fiducie sont réputées liées entre elles aux fins de l'application de l'article 55 L.I.R.
L'alinéa 248(25)a) L.I.R. énonce, quant à lui, une règle pour déterminer si une personne ou une société de personnes a un droit de bénéficiaire dans une fiducie donnée aux fins de l'application de la LIR.
Comme la notion de " personne ayant un droit de bénéficiaire " n'est pas pertinente aux fins de l'application du sous-alinéa 55(5)e)(ii) L.I.R., nous sommes d'avis que le sous-alinéa 55(5)e)(ii) L.I.R. ne peut être interprété en fonction de l'expression " droit de bénéficiaire " prévue à l'alinéa 248(25)a) L.I.R.
Il nous apparaît cependant que les droits décrits au sous-alinéa 55(5)e)(ii) L.I.R. et à l'alinéa 248(25)a) L.I.R. sont assez semblables.

Beneficial interest
Provision is made in subparagraph 55(5)(e)(ii) I.T.A. for a rule for determining whether persons are related for the purposes of section 55 I.T.A.. Subparagraph 55(5)(e)(ii) I.T.A. reads as follows:
(ii) where at any time a person is related to each beneficiary (other than a registered charity) under a trust who is or may (otherwise than by reason of the death of another beneficiary under the trust) be entitled to share in the income or capital of the trust, the person and the trust shall be deemed to be related at that time to each other and, for this purpose, a person shall be deemed to be related to himself, herself or itself,
Further, paragraph 248(25)(a) I.T.A. reads as follows:
(a) a person or partnership beneficially interested in a particular trust includes any person or partnership that has any right (whether immediate or future, whether absolute or contingent or whether conditional on or subject to the exercise of any discretion by any person or partnership) as a beneficiary under a trust to receive any of the income or capital of the particular trust either directly from the particular trust or indirectly through one or more trusts or partnerships;
Can the CRA indicate whether there is a difference between how the two passages should be interpreted or whether subparagraph 55(5)(e)(ii) I.T.A. should be interpreted in light of paragraph 248(25)(a) I.T.A.? If applicable, why does this difference exist, how must it be interpreted and why isn't reference simply made to paragraph 248(25)(a) I.T.A. in subparagraph 55(5)(e)(ii) I.T.A. and the exceptions left out?

Provision is made in paragraph 248(25)(a) I.T.A. for a rule to be used to determine whether a person or a partnership has a beneficiary interest in a particular trust for the purposes of the I.T.A.
Since the concept of "person beneficially interested" is irrelevant for the purposes of subparagraph 55(5)(e)(ii) I.T.A., we feel that subparagraph 55(5)(e)(ii) I.T.A. cannot be interpreted based on this concept provided in paragraph 248(25)(a) I.T.A.
However, we feel that the right described in subparagraph 55(5)(e)(ii) I.T.A. and paragraph 248(25)(a) I.T.A. are fairly similar.
