Dear XXXXXXXXXX,

Subject: Departure from Canada

This is in response to your request of July 9, 2004 concerning the above subject in relation to the following situation:

Situation

You and your XXXXXXXXXX year old son left Canada for Mexico on XXXXXXXXXX. The reason for that departure was your marriage to a Mexican. There is no planned return date to Canada. You have indicated in your letter that:

Question

You wish to know what procedures to follow with regard to your annual income tax returns and child benefit.

Comments

As this relates to your actual situation, it is for the relevant Tax Services Office to determine the appropriate tax treatment. We can, however, offer the following general comments which may not apply in full to your particular situation.

We understand from your letter that you left Canada permanently to live in Mexico on XXXXXXXXXX. As a resident of Canada until that date, you were taxable in Canada on all your income up to the date of your departure. You are therefore required to file a tax return for the 2004 taxation year and include all your income for the period up to the date of your departure. That return must be filed by 30 April 2005. For the purpose of computing your income for the taxation year in which you cease to be resident in Canada, you must include in your income any gain from the deemed disposition of your property on the date of your departure. There is a deemed disposition of the property of an individual ceasing to be resident in Canada, except for certain properties described in subparagraphs 128.1(4)(b)(i) to (v) of the Act (such as real property situated in Canada), and the gain from that deemed disposition must be included in computing that income. As a non-resident of Canada for the 2005 taxation year, you will only be required to file a tax return for that year if you were employed in Canada, carried on business in Canada or disposed of taxable Canadian property.

We believe that having left Canada, you will no longer be eligible for child tax benefits and you will have be required repay any overpayment of benefits. In this regard, it is stated in the T4056(E) booklet entitled "Emigrants and Income Tax - 2004" (copy attached) that if you receive a payment after emigrating, you should immediately inform the International Tax Services Office (ITSO) of the Canada Revenue Agency.

La présente est en réponse à votre demande du 9 juillet 2004 concernant le sujet en titre dans la situation suivante:

Situation

En compagnie de votre fils de XXXXXXXXXX ans, vous avez quitté le Canada à destination du Mexique le XXXXXXXXXX. Le motif de ce départ est votre mariage à un mexicain. Aucune date de retour au Canada n'est prévue. Vous avez indiqué dans votre lettre ceci:

"XXXXXXXXXX."

Vous voulez savoir quelles sont les procédures à suivre à l'égard de vos déclarations de revenu annuelles et des allocations pour enfants.

Commentaires

Puisqu'il s'agit de votre situation réelle, il appartient au bureau des services fiscaux concerné de déterminer le traitement fiscal adéquat. Nous pouvons cependant vous offrir les commentaires généraux suivants qui pourraient ne pas s'appliquer intégralement à votre situation particulière.

Nous comprenons de votre lettre que vous avez quitté le Canada de manière définitive pour aller vivre au Mexique le XXXXXXXXXX. À titre de résidente du Canada jusqu'à cette date, vous étiez imposable au Canada sur tous vos revenus jusqu'à la date de votre départ. Vous êtes donc tenue de produire une déclaration d'impôt pour l'année d'imposition 2004 et inclure tous vos revenus pour la période allant jusqu'à la date de votre départ. Cette déclaration doit être produite au plus tard le 30 avril 2005. Pour les fins du calcul de votre revenu pour l'année d'imposition au cours de laquelle vous cessez de résider au Canada, vous devez inclure dans vos revenus tout gain provenant de la disposition réputée de vos biens à la date de votre départ. En effet, le particulier qui cesse de résider au Canada est réputé avoir disposé de ses biens, à l'exception de certains biens visés aux sous-alinéas 128.1(4)b)(i) à (v) de la Loi (biens immeubles situés au Canada notamment), et le gain qui découle de cette disposition réputée doit être inclus dans le calcul de ce revenu. À titre de non-résidente du Canada pour l'année d'imposition 2005, vous n'aurez à produire une déclaration d'impôt pour cette année que si vous avez été employée au Canada, avez exploité une entreprise au Canada ou avez disposé d'un bien canadien imposable.

Nous croyons qu'ayant quitté le Canada, vous ne serez plus éligible aux prestations fiscales pour enfants et que vous devrez rembourser toute prestation reçue en trop. À cet égard, il est mentionné dans la brochure T4056(F) intitulée " Les émigrants et l'impôt - 2004 " (copie annexée) que si vous recevez un paiement après avoir émigré, vous devez informer immédiatement le Bureau international des services fiscaux (BISF) de l'Agence du revenu du Canada.
