Are indemnities and allowances paid under the Regulation respecting Indemnities and Allowances to Jurors and the Regulation respecting Indemnities and Allowances Payable to Witnesses Summoned before Courts of Justice taxable under the Income Tax Act?

Position:

1. The daily allowance paid to a juror and a witness must be included in the taxpayer's income.

2. Reasonable allowances to cover expenses incurred by the juror and witness for the purpose of performing these services need not be included in their respective incomes.

Reasons:

1. The compensation is a fee for services rendered.

2. These allowances serve to reimburse the taxpayer for expenses which the taxpayer would not normally have incurred but which the taxpayer has had to incur as a result of the taxpayer’s participation in the proceedings. These allowances appear reasonable in the circumstances.

Dear Madam,

Subject: Witness and jury fees and allowances

This is in response to your letter of March 10, 2004 in which you requested our opinion on the above subject. We apologize for the delay in responding to your request.

FACTS

When a jury is empanelled, the juror who serves on it is entitled to a daily monetary allowance of varying amounts depending on whether the hearing or deliberation takes place during the day, evening, etc.

In addition, the juror is entitled to an allowance for meals, lodging and transportation corresponding to that granted to staff members appointed under the Quebec Public Service Act.

By order of the judge and upon presentation of supporting documents, the juror is also entitled to an allowance for the care of children or other dependants and an allowance for psychological treatment.

In the context of a trial, a daily monetary allowance is also paid to a witness for loss of time. This allowance varies according to the type of witness. No allowance is paid to a witness who, by virtue of laws, decrees, contracts, agreements or collective agreements, does not suffer loss of earnings.

Like a juror, a witness is also entitled to an allowance for meals, lodging and transportation corresponding to that granted to staff members appointed under the Quebec Public Service Act.

QUESTION

You wish to know whether the compensation and allowances paid under the Regulation respecting Indemnities and Allowances to Jurors and the Regulation respecting Indemnities and Allowances Payable to Witnesses Summoned before Courts of Justice are taxable for the purposes of the Income Tax Act (the "Act").

OUR COMMENTS

As stated in paragraph 22 of Information Circular 70-6R5 dated May 17, 2002, it is the practice of our Directorate not to issue a written opinion regarding proposed transactions otherwise than by advance rulings. Furthermore, when it comes to determining whether a completed transaction has received appropriate tax treatment, that determination is made first by our Tax Services Offices as a result of their review of all facts and documents, which is usually performed as part of an audit engagement. However, we can offer the following general comments which may not apply in full to the situation you have submitted to us.

As stated in paragraph 6 of Interpretation Bulletin IT-377R, where a taxpayer receives an amount per diem for jury duty, the taxpayer is considered to be in receipt of a fee for services rendered, which is required to be included in the taxpayer's income pursuant to sections 3 and 4 of the Act. Expenses incurred for this purpose (in excess of any reimbursement or allowance received) may be deducted in computing the taxpayer's income from this source, to the extent that they are reasonable in the circumstances. Although this Interpretation Bulletin is currently archived, the above comments are still applicable.

In the present situation, we are of the view that the per diem amount paid to a juror and a witness must be included in the taxpayer's income since it constitutes fees for services rendered.

Reasonable allowances for expenses incurred by the juror and the witness in performing these services do not have to be included in their respective incomes since they serve to reimburse the taxpayer for expenses which the taxpayer would not normally have incurred but which the taxpayer had to incur as a result of participating in the trial.

The allowances discussed here seem reasonable in the circumstances as some are paid on the basis of supporting documents and all have a maximum amount set by law or regulation. A maximum amount is normally estimated on the basis of expenses actually incurred in similar circumstances.

Finally, it should be noted that childcare costs incurred and compensated for through the childcare allowance cannot be claimed as childcare costs for the purposes of the Act. Similarly, the costs of psychological treatment compensated by the allowance provided for this purpose cannot be claimed as medical expenses for the purposes of the Act.

2. Les allocations raisonnables pour couvrir les dépenses encourues par le juré et par le témoin aux fins de rendre ces services n'ont pas à être incluses dans leur revenu respectif.

Raisons:

1. L'indemnité constitue des honoraires pour services rendus.

2. Ces allocations servent à rembourser des dépenses du contribuable qu'il n'aurait normalement pas encourues mais qu'il a dû encourir du fait de sa participation au procès. Ces allocations semblent raisonnables dans les circonstances.

La présente est en réponse à votre lettre du 10 mars 2004 dans laquelle vous demandez notre opinion concernant le sujet mentionné en titre. Nous nous excusons des délais requis pour répondre à votre demande.

FAITS

Lorsqu'un jury est formé, le juré qui en fait partie a droit à une indemnité monétaire quotidienne de montants variables selon que l'audition ou la délibération a lieu le jour, le soir, etc.

De plus, le juré a droit à une allocation pour les repas, le coucher et le transport correspondant à celle accordée aux membres du personnel nommés suivant la Loi sur la fonction publique du Québec.

Sur ordonnance du juge et sur présentation de pièces justificatives, le juré a également droit à une allocation pour frais de garde d'enfants ou d'autres personnes à charge et une allocation pour traitement psychologique.

Dans le cadre d'un procès, une indemnité monétaire quotidienne est également versée à un témoin pour perte de temps. Cette indemnité est variable selon le genre de témoin. Aucune allocation n'est versée à un témoin qui, en vertu de lois, décrets, contrats, ententes ou conventions collectives, ne subit pas de perte de gain.

Tout comme un juré, un témoin a aussi droit à une allocation pour les repas, le coucher et le transport correspondant à celle accordée aux membres du personnel nommés suivant la Loi sur la fonction publique du Québec.

NOS COMMENTAIRES

Tel qu'il est mentionné au paragraphe 22 de la Circulaire d'information 70-6R5 du 17 mai 2002, notre Direction a comme pratique de ne pas émettre d'opinion écrite concernant des transactions projetées autrement que par voie de décisions anticipées. Par ailleurs, lorsqu'il s'agit de déterminer si une transaction complétée a reçu le traitement fiscal adéquat, la décision en revient d'abord à nos bureaux des services fiscaux à la suite de l'examen de tous les faits et documents, ce qui est généralement effectué dans le cadre d'une mission de vérification. Néanmoins, nous vous offrons les commentaires généraux suivants qui pourraient cependant ne pas s'appliquer intégralement à la situation que vous nous avez soumise.

Tel que mentionné au paragraphe 6 du Bulletin d'interprétation IT-377R, lorsqu'un contribuable reçoit une indemnité quotidienne en qualité de juré, on considère qu'il reçoit des honoraires pour services rendus, lesquels doivent être inclus dans son revenu en vertu des articles 3 et 4 de la Loi. Les frais engagés à cette fin (en sus de tout remboursement ou de toute allocation reçus) peuvent être déduits du revenu du contribuable provenant de cette source dans la mesure où ils sont raisonnables dans les circonstances. Même si ce bulletin d'interprétation est présentement archivé, les commentaires ci-dessus sont toujours applicables.

Dans la situation présente, nous sommes d'avis que l'indemnité quotidienne versée à un juré et à un témoin doit être incluse dans le revenu du contribuable puisqu'elle constitue des honoraires pour services rendus.

Les allocations raisonnables pour couvrir les dépenses encourues par le juré et par le témoin aux fins de rendre ces services n'ont pas à être incluses dans leur revenu respectif puisqu'elles servent à rembourser le contribuable des dépenses qu'il n'aurait normalement pas encourues mais qu'il a dû encourir du fait de sa participation au procès.

Les allocations dont il est question dans la présente nous semblent raisonnables dans les circonstances puisque certaines sont versées sur présentation de pièces justificatives et toutes ces allocations ont un montant maximum fixé par une loi ou un règlement. Un montant maximum est normalement estimé à partir de dépenses réellement encourues dans des circonstances similaires.

Finalement, il est à noter que les frais de garde encourus et qui sont compensés via l'allocation prévue à cette fin ne peuvent être réclamés à titre de frais de garde d'enfants aux fins de la Loi. De même, les frais pour traitement psychologique compensés au moyen de l'allocation prévue à cette fin ne peuvent être réclamés à titre de frais médicaux aux fins de la Loi.
