Position: 1. In the particular situation, yes.

2. Notwithstanding that a pick-up truck was included in Class 10.1 in the taxation years beginning before 2003, it will be included in Class 10 in the taxation years beginning after 2002 if the pick-up truck falls within the exception set out in subparagraph (e)(iii) of the definition of automobile in subsection 248(1) of the Act. In such a case, paragraph 13(7)(g) will not apply to limit the capital cost of the Class 10 property.

3. The value of the employee benefit in respect of such a pick-up truck would be included in income under the general provisions of paragraph 6(1)(a) of the Act.

Reasons: 1. Subparagraph (e)(iii) of the definition of automobile in subsection 248(1) of the Act is applicable to taxation years that begin after 2002. The pick-up truck does not fall within the other exceptions set out in paragraph (b) through (e) of that definition. Therefore, in the taxation year that begins in 2002, the pick-up truck is an automobile, its capital cost is included in Class 10.1 and its capital cost is limited pursuant to paragraph 13(7)(g) of the Act.

2. Notwithstanding the fact that the pick-up truck was an automobile and was included in a particular class at the end of a taxation year, the pick-up truck can be reclassified and be included in another prescribed class at the end of a subsequent taxation year if the property does not fall within that particular class at the end of that subsequent taxation year. As the exception set out in subparagraph (e)(iii) is applicable to the taxation years that begin after 2002, a pick-up truck that falls within that exception will not be an automobile for the taxation year that begins after 2002. Subsection 13(5) of the Act will apply to transfer the pick-up truck to Class 10.

3. The exclusion set out in subparagraph 6(1)(a)(iii) of the Act does not apply because the pick-up truck is not an automobile for the purpose of the Act.

Definition of the term "automobile”

This is further to your letter of October 27, 2003 requesting our views on the definition of "automobile" in subsection 248(1) of the Income Tax Act (the "Act").

Facts

A customer acquired an extended cab pick-up truck on XXXXXXXXXX, which was during his fiscal period ending March 31, 2003. The customer paid $XXXXXXXXXX (excluding goods and services tax and Quebec sales tax, which were refunded).

In the year the truck was acquired, it was not used all or substantially all for the transportation of goods, equipment or passengers in the course of gaining or producing income. However, it was used primarily for the transportation of goods, equipment or passengers in the course of gaining or producing income at one or more locations in Canada that are:

described, in respect of any of the occupants of the vehicle, in subparagraph 6(6)(a)(i) or (ii);
located at least 30 kilometres outside the nearest point on the boundary of the nearest urban area, as defined by the last census dictionary published by Statistics Canada before the year in question, that has a population of at least 40,000 individuals as determined in the last census published by Statistics Canada before that year.

You wish to assess the taxation year ending March 31, 2003, on the basis that the vehicle is an automobile and a passenger vehicle for that year, that it was included in Class 10.1 of Schedule II to the Income Tax Regulations ("Class"), and that its capital cost was limited by paragraph 13(7)(g).

Questions

You asked if the vehicle is an automobile and a passenger vehicle for the taxation year ending March 31, 2003, and if you can assess that year as wished.

Given the change in the definition of "automobile" in subsection 248(1) (the “definition of automobile"), you wish to know whether the vehicle still qualifies as an automobile and passenger vehicle for the taxation year ending March 31, 2004, and the consequences for the class of the property and its capital cost for undepreciated capital cost (UCC) purpose if it does not.

You also asked us about the implications for the benefit conferred on an employee for personal use of a vehicle for the years 2003 and 2004 following the change in the definition of the term automobile.

Our Comments

Paragraph (e) of the definition "automobile" has been amended to add, inter alia, subparagraph (e)(iii) to the exclusions in that paragraph. The amendments to paragraph (e) of the definition apply to taxation years that begin after 2002.

According to the information provided, the use of the pick-up truck in its year of acquisition corresponds to the use described in subparagraph (e)(iii) of the definition of automobile. However, given the effective date of that subparagraph, it does not apply to the client for the client’s taxation year ending March 31, 2003.

According to that information, the other exclusions provided for in subparagraph (e) of the definition of automobile would not apply. In fact, the pick-up truck has more than three seats, thus not meeting the exclusion in subparagraph (e)(i) of that definition, and according to you, the condition in subparagraph (e)(ii) of that same definition would not be satisfied either, because the pick-up truck is not used all or substantially all for the transportation of goods, equipment or passengers in the course of earning or producing income.

If the extended cab pick-up truck has a maximum seating capacity of nine, including the driver's seat, it would meet the definitions of "automobile" and "passenger vehicle" in subsection 248(1) for the taxation year ending March 31, 2003. Given the cost of this passenger vehicle, it would be in a separate Class 10.1 for the taxation year ending March 31, 2003, and the capital cost for that taxation year would be limited by virtue of paragraph 13(7)(g).

On the other hand, even if an extended cab pick-up truck was an automobile and in a specific class at the end of one taxation year, the truck may be reclassified into another prescribed class in a subsequent taxation year if the property no longer fits, at the end of that subsequent taxation year, the description of the class in which it was included. This may occur, for example, because of a change in legislation.

Thus, in this situation, because of the legislative change to the definition of automobile that applies to taxation years beginning after 2002, the pick-up truck would no longer qualify as an automobile or passenger vehicle (as defined in subsection 248(1)) for the taxation year ending March 31, 2004. As stated above, the pick-up truck would be excluded by subparagraph (e)(iii) of the definition of automobile.

In this circumstance, the pick-up truck would now be a Class 10 property instead of a Class 10.1 property and would have to be reclassified in the manner provided for in subsection 13(5). Thus, when calculating the UCC of Class 10 as of March 31, 2004, the capital cost of the pick-up truck would be included in the description of A in the definition of UCC in subsection 13(21). This cost would not be restricted by paragraph 13(7)(g) because, since the pick-up truck was no longer a passenger vehicle, that paragraph no longer applied to determine the capital cost of the pick-up truck as of March 31, 2004.

The total depreciation allowed, as calculated under paragraph 13(5)(b), should also be subtracted from Class 10.1 and added to Class 10. The calculation in subparagraph 13(5)(b)(i) takes into account the capital cost of the property. For this purpose, it is our view that the capital cost that was used for Class 10.1, i.e. the capital cost limited by paragraph 13(7)(g), should be used.

In terms of the implications for the benefit conferred on an employee, the pick-up truck no longer meets the definition of automobile for the employee's taxation year ending December 31, 2003 and subsequent years. Consequently, the employee would not include any amount pursuant to paragraphs 6(1)(e) and 6(1)(k). On the other hand, if the employer makes the pick-up truck available to the employee for personal use, the value of the benefit that would be conferred on the employee would be included in the employee's income pursuant to paragraph 6(1)(a). This is explained in paragraph 23 of Interpretation Bulletin IT-63R5.

Définition du terme " automobile "

La présente fait suite à votre lettre du 27 octobre 2003 dans laquelle vous nous demandez notre opinion concernant la définition du terme " automobile " inscrite au paragraphe 248(1) de la Loi de l'impôt sur le revenu (ci-après la " Loi ").

Faits

Un client fait l'acquisition d'une camionnette à cabine allongée le XXXXXXXXXX, soit au cours de son exercice financier se terminant le 31 mars 2003. Il a payé XXXXXXXXXX $ (excluant la taxe sur les produits et services et la taxe de vente du Québec qui lui ont été remboursées).

Au cours de l'année d'acquisition de la camionnette, elle n'a pas été utilisée en totalité ou presque au transport de marchandises, de matériel ou de passagers en vue de gagner un revenu. Cependant, elle était utilisée principalement pour le transport de marchandises, de matériel ou de passagers en vue de gagner un revenu à un ou plusieurs endroits au Canada qui sont, à la fois :

visés, pour ce qui est d'un ou de plusieurs des occupants du véhicule, aux sous-alinéas 6(6)a)(i) ou (ii) de la Loi;
situés à au moins 30 kilomètres du point le plus rapproché de la limite de la plus proche région urbaine, au sens du dernier dictionnaire du recensement publié par Statistique Canada avant l'année en question, qui compte une population d'au moins 40 000 personnes selon le dernier recensement publié par Statistique Canada avant cette même année.

Vous désirez cotiser l'année d'imposition se terminant le 31 mars 2003 en considérant que le véhicule est une automobile et une voiture de tourisme pour cette année, qu'il fait partie de la catégorie 10.1 de l'annexe II du Règlement de l'impôt sur le revenu (ci-après " catégorie ") et que son coût en capital est limité par l'alinéa 13(7)g) de la Loi.

Questions

Vous nous demandez si le véhicule est une automobile et une voiture de tourisme pour l'année d'imposition se terminant le 31 mars 2003 et si vous pouvez établir la cotisation de cette année tel que vous le désirez.

Étant donné le changement de la définition du terme " automobile " au paragraphe 248(1) de la Loi (ci-après " la définition du terme automobile "), vous désirez savoir si le véhicule se qualifie toujours d'automobile et de voiture de tourisme pour l'année d'imposition se terminant le 31 mars 2004 ainsi que les conséquences à l'égard de la catégorie du bien et de son coût en capital aux fins de la fraction non amortie du coût en capital (FNACC) si ce n'est pas le cas.

Vous nous questionnez également sur les implications au niveau de l'avantage conféré à un employé en raison de l'usage personnel du véhicule par ce dernier pour les années 2003 et 2004 à la suite du changement de la définition du terme automobile.

Nos commentaires

L'alinéa d) de la définition du terme automobile a été modifié pour ajouter, entre autres, le sous-alinéa d)(iii) aux exclusions prévues à cet alinéa. Les modifications à l'alinéa d) de cette définition sont applicables aux années d'imposition commençant après 2002.

Selon ce que vous nous mentionnez, l'utilisation de la camionnette au cours de son année d'acquisition correspond à l'utilisation décrite au sous-alinéa d)(iii) de la définition du terme automobile. Cependant, étant donné la date d'entrée en vigueur de ce sous-alinéa, il ne s'applique pas au client pour son année d'imposition se terminant le 31 mars 2003.

Selon ce que vous nous mentionnez, les autres exclusions prévues à l'alinéa d) de la définition du terme automobile ne s'appliqueraient pas. En effet, la camionnette a plus de trois places assises ne répondant pas ainsi à l'exclusion inscrite au sous-alinéa d)(i) de cette définition et d'après vous, la condition inscrite au sous-alinéa d)(ii) de cette même définition ne serait pas respectée non plus car l'utilisation de la camionnette n'est pas en totalité ou presque pour le transport de marchandises, de matériel ou de passagers en vue de gagner un revenu.

Si la camionnette à cabine allongée compte au maximum neuf places assises, y compris celle du conducteur, elle répondrait aux définitions des termes " automobile " et " voiture de tourisme " au paragraphe 248(1) de la Loi pour l'année d'imposition se terminant le 31 mars 2003. Étant donné le coût de cette voiture de tourisme, elle ferait partie d'une catégorie 10.1 distincte pour l'année d'imposition se terminant le 31 mars 2003 et le coût en capital, pour cette année d'imposition, serait limité en vertu de l'alinéa 13(7)g) de la Loi.

Par contre, même si une camionnette à cabine allongée était une automobile et faisait partie d'une catégorie spécifique à la fin d'une année d'imposition, la camionnette peut être reclassifiée dans une autre catégorie prescrite au cours d'une année d'imposition subséquente si le bien ne correspond plus, à la fin de cette année d'imposition subséquente, à la description de la catégorie dans laquelle il était inclus. Cette situation peut survenir par exemple en raison d'un changement législatif.

Ainsi, dans la présente situation, en raison du changement législatif à la définition du terme automobile qui s'applique aux années d'imposition commençant après 2002, la camionnette ne se qualifierait plus à titre d'automobile ni de voiture de tourisme (selon les définitions du paragraphe 248(1) de la Loi) pour l'année d'imposition se terminant le 31 mars 2004. Tel que mentionné précédemment, la camionnette serait exclue par le sous-alinéa d)(iii) de la définition du terme automobile.

Dans une telle circonstance, la camionnette serait maintenant un bien de la catégorie 10 au lieu de la catégorie 10.1 et elle devrait être reclassifiée de la manière prévue au paragraphe 13(5) de la Loi. Ainsi, lors du calcul de la FNACC de la catégorie 10 au 31 mars 2004, le coût en capital de la camionnette serait compris à l'élément A de la formule figurant à la définition de la FNACC au paragraphe 13(21) de la Loi. Ce coût ne serait pas limité par l'alinéa 13(7)g) de la Loi puisque, la camionnette n'étant plus une voiture de tourisme, cet alinéa ne s'applique plus pour calculer le coût en capital de la camionnette au 31 mars 2004.

Il faudrait également soustraire de la catégorie 10.1 et ajouter à la catégorie 10 l'amortissement total accordé, tel que calculé à l'alinéa 13(5)b) de la Loi. Le calcul prévu au sous-alinéa 13(5)b)(i) de la Loi tient compte du coût en capital du bien. À cette fin, nous sommes d'avis qu'il faudrait utiliser le coût en capital qui était utilisé pour la catégorie 10.1 soit le coût en capital limité par l'alinéa 13(7)g) de la Loi.

Pour ce qui est des implications au niveau de l'avantage conféré à un employé, la camionnette ne rencontre plus la définition du terme automobile pour l'année d'imposition de l'employé qui se termine le 31 décembre 2003 et pour les années subséquentes. Par conséquent, l'employé n'inclurait aucun montant en vertu des alinéas 6(1)e) et 6(1)k) de la Loi. Par contre, si l'employeur met la camionnette à la disposition de l'employé pour des fins personnelles, la valeur de l'avantage qui serait conféré à l'employé serait incluse dans le calcul de son revenu en vertu de l'alinéa 6(1)a) de la Loi. Vous trouverez des explications à cet effet au paragraphe 23 du Bulletin d'interprétation IT-63R5.

Pour votre information, une copie de cette lettre sera épurée selon les critères contenus dans la Loi sur l'accès à l'information et sera disponible dans la Bibliothèque de l'ADRC qui se trouve sur votre réseau local ou sur Intranet. Une copie de la version épurée sera également distribuée aux éditeurs fiscaux commerciaux pour insertion dans leurs banques de données. Le processus d'épuration permet d'enlever toute information qui n'a pas à être dévoilée y compris toute information qui permettrait l'identification du contribuable. Si votre client demande une copie de cette lettre, vous pouvez lui remettre une copie épurée de la lettre telle qu'elle se trouve dans la Bibliothèque de l'ADRC. Le client peut aussi demander une copie de la lettre épurée en vertu des critères de la Loi sur la protection des renseignements personnels sur laquelle apparaît le nom du contribuable. Toute demande à cet effet devrait être faite auprès de Madame Jackie Page au (819) 994-2898. La copie épurée selon les critères de la Loi sur la protection des renseignements personnels vous sera alors envoyée pour que vous puissiez la remettre à votre client.

An extended-cab pick-up truck was included in Class 10.1 when it was acquired in 2002 but fell into Class 10 for years commencing after 2002 because of the addition of the exclusion in s. (e)(iii) of the automobile definition, so that it was transferred to class 10 pursuant to s. 13(5). In this regard, the Directorate indicated that the capital cost of the Class 10.1 property should still reflect the s. 13(7)(g) limitation, and that employee benefits for use of the truck should be determined under s. 6(1)(a) rather than ss. 6(1)(e) and (k).
